| Abstract: | Tato diplomová práce se zabývá problematikou dopravních přestupků a jejich trestání se současným zkoumáním správního uvážení. Práce se člení na šest kapitol, přičemž v první kapitole je představena právní úprava této problematiky na úrovni jak tuzemské, tak mezinárodní. Dále se práce zabývá významnou judikaturou z této oblasti a analýzou vybraných dopravních přestupků. Dále je pojednáváno o jednotlivých druzích správního řízení, která se v oblasti dopravních přestupků často vyskytují. Práce rovněž obsahuje kapitolu týkající se opravných a dozorčích prostředků spolu s ochranou ve správním soudnictví. Poslední kapitola je věnována institutu správní diskrece spolu s vyhodnocením dotazníkového šetření. |
| Abstract in different language: | This thesis deals with the issue of traffic offences and their sanctions with a simultaneous examination of administrative discretion. The thesis is divided into six chapters, with the first chapter presenting the legal regulation of this issue at both domestic and international level. The thesis then examines the relevant case law in this area and analyses selected traffic offences. It then discusses the different types of administrative proceedings that are frequently encountered in the field of traffic offences. The work also includes a chapter on remedies and supervisory measures, together with the judicial protection. The last chapter is devoted to the institute of administrative discretion together with an evaluation of the questionnaire. |
