| Abstract: | Tématem předložené diplomové práce je trestněprávní institut účinné lítosti. Účinná lítost je jedním z důvodů zániku trestní odpovědnosti. V práci je nejprve popisován historický vývoj tohoto institutu a postupné formování její úpravy. Následně je účinná lítost porovnána s ostatními důvody zániku trestní odpovědnosti. Jádrem práce jsou kapitoly, které pojednávají o současné úpravě účinné lítosti. Prostor je věnován i komparaci české právní úpravy s úpravou zahraniční a závěr přináší celkovému shrnutí uvedených poznatků. Práce obsahuje i kapitolu de lege ferenda, která uvádí některé mé vlastní názory a náměty k dané problematice. |
| Abstract in different language: | This diploma work discusses the subject of the extinction of criminal responsibility through effective repentance. Effective repentance is the topic of this diploma work. Due to the extinction of criminal responsibility, the state is not allowed to punish the perpetrator. The introduction is followed by the chapter describing history of the institute of the effective repentance. Effective repentance is also compared to other causes of the extinction of criminal responsibility. Diploma work contains comparison of the Czech legal form of the effective repentance with foreign legal form. |
