| Abstract: | V mé práci se pokusím vysvětlit a podrobně popsat institut nutné obrany a veškeré s tím související problémy např. právo nosit, vlastnit a použít legálně drženou zbraň. V první kapitole se budu zabývat nutnou obranou v kontextu jejího vzniku, příčin a důsledků. Druhá kapitola se zabývá okolnostmi vylučujícími protiprávnost jednání. Následující třetí kapitola pak bude pojednávat o historickém vývoji institutu nutné obrany na území České republiky (myšleno ČSFR) do roku 1950 ? a následně pak od roku 1950 až po současnost. Čtvrtá kapitola souvisí s porovnáním nutné obrany se slovenským právním řádem a německým právním řádem. Pokusím se srovnat právní úpravu nutné obrany v obou zemích s naší úpravou a popsat jejich odlišnosti. Mým cílem je obecné vymezení pojmu nutná obrana, podrobný pohled na tuto problematiku s ohledem na judikaturu a dále vysvětlení pojmu okolností vylučujících protiprávnost. Dále bych ráda objasnila právní pojmy, které s danou problematikou souvisí a jsou nezbytné pro její pochopení. Zároveň se chci podrobně zabývat pojmem nutné obrany, vybočením a překročením zákonem stanovených pravidel, porovnáním shodných a rozdílných aspektů z pohledu rozdílných právních řádů Slovenské republiky a Spolkové republiky Německo. V mé práci se budu snažit vycházet z trestní úpravy dle zákona č. 141/1961 Sb., trestní zákon (dále jen TZ) a ze zákona č. 40/2009 Sb., trestního zákoníku, ve znění pozdějších předpisů (dále jen TrZ.). |
| Abstract in different language: | In my thesis, I try to explain and detail the institute self-defense and all related issues such as the right to wear, possess, and use a legally held weapon. The idea of self defense of is in my opinion, impossible and in practice works very uneven. In the first chapter, I will discuss the necessary defense in the context of its formation causes and consequences. The second chapter deals with the circumstances excluding infringement.The next chapter will discuss the historical development of the institute of self-defense in the Czech Republic until 1950 and subsequently from 1950 to present. Another chapter relates to comparing self-defense with Slovak law and German law.My goal is a general definition of self-defense, a detailed view of this issue with regard to the case and explain the concept of the circumstances of justification, and of course other concepts important to their recovery. At the same time I want to look in detail at the concept of self-defense, lateral bending, and reaching the statutory rules, the comparison of identical and different aspects from the perspective of the different legal systems of the Slovak Republic and the Federal Republic of Germany.Along with the institution of self-defense is inextricably linked to the possibility of owning, wearing and where justified, to use a weapon. If the authorities can not avert the attack on the interests protected by the Criminal Code, should be entitled to a citizen of the modern state, such an attack to distract himself. In modern civilized countries it is quite common that citizens can legally own weapon to defend property against intruders. The Charter of Fundamental Rights and Freedoms are a few articles that directly refer to individual freedom, the right to own property, the right to inviolability of the home, etc. This law should guarantee the state and strictly punish violations.In my work, I will work with criminal law pursuant to Act No. 141/1961 Coll., The Penal Code (hereinafter CC) and Act No. 40/2009 Coll. Penal Code, as amended (hereinafter referred to as the Criminal Code. ). |
