| Abstract: | V této práci se pokusím vymezit základní pojem věcných břemen, druhy věcných břemen, jejich způsob vzniku, za jakých okolností dochází ke změnám a k jejich zániku, jejich staro nového rozdělení na služebnosti a reálná břemena, a to podle stávající právní úpravy z. č. 40/1964 Sb. a podle nové právní úpravy z. č. 89/2012 Sb. Dále se okrajově zaměřím na jejich historický vývoj, jelikož základy tohoto institutu jsou zaneseny již v římském právu. Cílem diplomové práce je, aby čtenář získal základní a ucelený přehled o institutu věcného břemena, jeho právní úpravy a historie. |
| Abstract in different language: | In this work I will try to define the basic concept of easements, the types of easements, and under what circumstances there are formed. in which situation changes are made and their demission. the new division of their old servitude to a real burden, according to the current legislation of. no. 40 / 1964 Coll. and under the new legislation from. no. 89/2012 Coll. Furthermore marginally focus on their historical development, as the foundation of this institute are already entered in Roman law. The aim of this thesis is that the reader gets the basic and comprehensive overview of the Institute of the easement, the legislation and history. |
