| Abstract: | Tato diplomová práce se bude zabývat trestem domácího vězení, který byl v ČR do praxe zaveden v roce 2010. První část práce bude věnována teoretickým aspektům, týkajícím se tematiky alternativních trestů a trestu domácího vězení. Kromě historického exkurzu a pojednání o účelu alternativního trestání v České republice, bude již konkrétně trest domácího vězení rozebrán z jak z pohledu trestního práva hmotného a procesního, tak i ve svém celkovém kontextu (typy, možnosti využití a ukládání, atd.). Další část textu se bude zabývat tím, jak probíhá samotný výkon trestu domácího vězení, jaký stupeň kontroly je odsouzeným věnován a v neposlední řadě také rolí a funkcí Probační a mediační služby ČR. Pozornost bude soustředěna i na stručnou komparaci se zahraniční právní úpravou. Závěrečná část diplomové práce bude pojata spíše prakticky. Budou zde uvedeny některé konkrétní příklady toho, jak probíhá výkon trestu domácího vězení. V anketě mezi soudci některých soudů ČR pak budou zjišťovány důvody poměrně malého využívání a ukládání trestu domácího vězení zdejšími soudci. Úplný závěr práce bude konečným zhodnocením zjištěných poznatků. |
| Abstract in different language: | This thesis main theme is house arrest sanction, which was introduced in the Czech republic in 2010. The first part of the thesis will be devoted to theoretical aspects relating to the topic of alternative sentencing and punishment and house arrest sanction. Besides the historical excursus and a treatise on the purpose of alternative forms of punishment in the Czech republic, concretelly the house arrest sanction will be analyzed from the perspective of criminal law and procedure, as well as in its overall context. Another part will examine how is the house arrest sanction being carried out, what degree of control is dedicated to the convicted and last but not least, the roles and functions of the Probation and Mediation Service will be mentioned. Attention will also be focused on a comparison with some foreign legislation. The final part of the thesis will be conceived more practically. There will be some specific examples of how the house arrest sanction works in practise and how the criminal justice should and should not function in relation to this concrete sentence. In a survey among judges of certain courts of the Czech republic the author will try to detect the cause of the relatively small use and storage of house arrest by local judges. The very end of the work will be the final evaluation findings (advantages, disadvantages, subjective opninions, etc.). |
