| Abstract: | Autor této práce popisuje přestupkové řízení v 1. stupni pod vlivem změn zákonem č. 204/2015 Sb. na přestupkový zákon č. 200/1990 Sb. s účinností od 1. 10. 2015, jakož i účinností od 1. 10. 2016. Na počátku práce jsou vymezeny hlavní termíny jako rozdíly mezi správním deliktem a přestupkem, dále pak vztah mezi přestupkovým zákonem a správním řádem. Druhá kapitola pojednává o příslušnosti správních orgánů, které jsou kompetentní k projednávání přestupků. Třetí kapitola vymezuje účastníky přestupkového řízení jako obviněného z přestupku, poškozeného, vlastníka zabrané věci a ke konci navrhovatele přestupku. Čtvrtá kapitolu popisuje samotný postup v 1. stupni přestupkového řízení. Postup je popsán od zjištění skutečnosti spáchání přestupku, průběhu řízení až po vydání rozhodnutí včetně jeho druhů a náležitostí. Pátá kapitola se věnuje zkráceným přestupkovým řízením jako blokové a příkazní. Autor se zaměřuje především na ukládání sankcí a možné obraně ve zkrácených řízeních. Problematika šesté kapitoly se věnuje primární změně zákonem č. 204/2015 Sb., a sice zavedení evidence přestupků. Autor za užití analogie popisuje ustanovení rejstříku trestů oproti přestupkové evidenci, zatímco popisuje účel, rozsah, teoretické a praktické dopady na přestupkové řízení. V poslední kapitole rekapituluje autor poznatky předchozích částí a vytyčuje nejvíce problematické ustanovení změn zák. č. 204/2015 Sb. |
| Abstract in different language: | The author attempted to turn the attention of a professional reader to the process of offence proceedings focused on the 1. degree under the influence of the amendment no. 204/2015 of the Legal Code and its current transformation of the Offence statute no. 200/1990 of the Legal Code. In the very beginning of this thesis the main terms like the difference between administrative tort and administrative offence, and the affiliation between Offence statute and Administrative code are being delimited. The second chapter deals with both competence of the appropriate authority and the regulatory compliance of the offence administration. The third chapter determines the participants of the offence proceeding like 1) the person accused from the offence, 2) the person harmed by the offence, 3) the owner of the subject in question and in the end 4) the complainant of the offence. The fourth chapter describes the whole procedure in 1. degree from the moment of detection of the fact of offence perpetration, through the launch of the whole administrative procedure, to the progress of its solution and administrative decision with its types. The fifth chapter is devoted to the so called shortened offence proceedings like block procedure and ordering procedure. The author aimed especially at sanctions and defences in the shortened offence proceedings. The focus of the sixth chapter is to provide reasons for an essential update of the amendment no. 204/2015 of the Legal Code and of the Offence register. The author draws analogy between the Criminal and Offence registers, while describing the purpose, extent and the theoretical and practical effect of the Offence register. In the last chapter the author summarizes all discrepancies of previous chapters and marks out the of most debateable regulations of the amendment no. 204/2015 of the Legal Code. |
