| Abstract: | Tato práce se věnuje principu rovnosti a s ním související diskriminaci. Práce je rozdělena do několika kapitol První a druhá kapitola popisuje pojmy rovnost a diskriminace - druhy, typy, význam. Třetí kapitola uvádí právní ukotvení rovnosti a diskriminace v mezinárodních smlouvách i vnitrostátním právním řádu. Čtvrtá kapitola obsahuje některé aktuální otázky v souvislosti s rasovou a etnickou diskriminací migraci cizinců na území ČR a národnostní složení některých zemí Rady Evropy. Pátá kapitola obecně shrnuje rozhodovací praxi soudů v oblasti diskriminace. Dále stručně popisuje konkrétní případ nepřímé rasové diskriminace posouzený Ústavním soudem ČR i Evropským soudem pro lidská práva. |
| Abstract in different language: | The subject of this theses is to describe the principe of equality and the relating discrimination. The theses is devided into several chapters. First and second chapter describe the terms equality and discrimination their kinds, types and meaning. Third chapter states which legislation includes these principles international treaties and national legislation. Fourth chapter represents some current issues about migration of foreigners in the Czech Republic and national composition of the population in some member states of the Council of Europe. The fifht chapter summarizes discrimination in consistent judicature of the courts. It briefly describes a specific case of the indirect racial discrimination judged by the Constitutional Court of the Czech Republic and the European Court of Human Rights. |
