| Abstract: | Diplomová práce se zabývá postavením a funkcemi České národní banky v ústavním systému České republiky. Věnuje se také tématům, které s touto problematikou úzce souvisí. Zejména historickému vývoji centrálního bankovnictví na území českých zemí, jehož znalost je důležitá pro pochopení právního zakotvení centrální banky dnes. Důležitá je kapitola o ústavním zakotvení České národní banky, kde je rozebrán hlavní cíl činnosti České národní banky, nezbytnost její nezávislosti, judikatura Ústavního soudu související s danou problematikou a vztah České národní banky k ostatním ústavním orgánům. Dále se zabývá postavením České národní banky v právním řádu České republiky a analyzuje její jednotlivé úkoly, kterými jsou emisní činnost, měnová politika, devizová činnost, dohledová a regulační činnost. Zabývá se také komparací s vybranými světovými centrálními bankami na Slovensku, ve Velké Británii a Spojených státech amerických. A na konec jsou uvedeny návrhy de lege ferenda, které vychází ze studia dané problematiky při vypracování této diplomové práce. |
| Abstract in different language: | This thesis looks into position and functions of the Czech National Bank in the constitutional system of the Czech Republic. It deals with topics that are closely related to it, especially the historic development of central banking in the territory of Czech Lands the knowledge of which is important for understanding of central bank´s regulations nowadays. Crucial is the chapter about constitutional regulations of the Czech National Bank where the main goal of Czech National Bank´s operation, necessity of its independence, judicature of Constitutional Court stated to given issues and relation of the Czech National Bank to other constitutional authorities are analysed. Next it covers position of the Czech National Bank in the rule of law of the Czech Republic and analyses its particular targets which are activity of issue, monetary policy, exchange activity, supervising and regulatory activity. It also deals with comparison with representative world´s central banks - in Slovakia, Great Britain and the United States of America. Finally, there are stated bills de lege ferenda which proceed from the research of this thesis's given issue. |
