| Abstract: | Tato diplomová práce pojednává o problematice místního referenda. Jejím cílem bylo představení současné právní úpravy na konkrétním příkladu místního referenda konaného na území města Plzně. Práce obsahuje několik částí. První z nich představuje pojem demokracie, její dělení a formy přímé demokracie. Druhá část se věnuje referendu jako jedné z forem přímé demokracie. Poslední a hlavní část se věnuje právní úpravě místního referenda v České republice prezentováním na příkladu konání konkrétního referenda v Plzni. Práce kriticky hodnotí právní úpravu a poskytuje tím čtenáři prostor pro zamyšlení nad klady i zápory legislativního řešení. Práce demonstruje i značnou možnost zneužití tohoto demokratického institutu. |
| Abstract in different language: | The thesis deals with the issue of local referendum. Its objective is to present current legislation on the case of the local referendum organized in the City of Pilsen. The thesis consists of several parts. The first one presents the term "democracy", its division and different forms of direct democracy. The second part describes referendum as one of the form of direct democracy. The last and main part of the thesis explains the legislative rules of local referendum in the Czech Republic by an example of the local referendum organized in the City of Pilsen. The thesis critically evaluates legislation and provides for an opportunity to analyse the pros and cons (the strengths and weaknesses) of the legislation. The thesis also demonstrates the possibility of an abuse of this democratic institute. |
