| Abstract: | Autor poukazuje na skutečný, či domnělý trend „vyprazdňování“ demokratických institucí, signalizovaný Colinem Crouchem, ale i českými autory, jako Havel nebo Klaus. Ilustruje ho na přenášení pravomoci k odstraňování sporů v oblasti soukromoprávních vztahů z oblasti moci soudní do oblasti moci výkonné na příkladech z oblasti práva daňového nebo spotřebitelského. Závěrem polemizuje nad pojmy „postdemokracie“ a „reálná demokracie“. |
| Abstract in different language: | The author points out the actual or alleged trend of democratic institution „emptying“ as signalled by Colin Crouch, as well as by Czech authors, such as Havel or Klaus. The author illustrates this trend on the delegation of powers to eliminate disputes in the area of private-law relationships from the judicial power to the executive power, using examples from tax and consumer law. In the final part, the author polemicizes over the terms „post-democracy“ and „real democracy“. |
