Abstract: | Příspěvek se zabývá aktuální problematikou rekodifikace veřejného stavebního práva, konkrétně právními otázkami, které vyvolává nestandardní přístup státu k legislativnímu procesu přípravy věcného záměru nového stavebního zákona a s tím spojených změn v souvisejících právních předpisech. Autor podává kritický rozbor některých klíčových ustanovení z pohledu ochrany veřejných zájmů, především zájmů na ochraně životního prostředí a zajištění práv veřejnosti. |
Abstract in different language: | Author deals with the recent most important topic, recodification of th public building legislation in the Czech Republic, especially the non-standard legislative procedure – a preparing of the new building legislation and the proposal for the amendments of the key environmental legislation. This article focuses on the selected main problems of this recodification, namely the public participation in building permitting process and the protecting of the public interest in environmental protection. |
