| Abstract: | S účinnosti k 1. lednu 2014 byla v českém právním řádu zakotvena úprava nabytí od neoprávněného, která se uplatní obecně vůči všem subjektům soukromoprávních vztahů. Tato práce si klade za cíl rozebrat a analyzovat vybrané aspekty takového nabývání vlastnického práva ve vztahu k věcem, které se nezapisují do veřejných seznamu, v kontextu nové české soukromoprávní úpravy. Její ambicí je taktéž zodpovězení dalších otázek s touto problematikou úzce se pojících a prezentace vlastních stanovisek ohledně dílčích aspektů této materie. |
| Abstract in different language: | Effective as of January 1, 2014, legislation regulating the acquisition of the right of ownership from a non-entitled person was enacted in the Czech legal system. The regulation applies generally to all subjects of private law relations. The aim of this Thesis is to analyse, within the context of new Czech private legislation, selected aspects of the acquisition of a property right from an unauthorised person concerning the matters which are not registered in the public list. The ambition of this thesis is also to answer questions related to this issue and to present the author's opinions on partial aspects of the matter. |
