| Abstract: | Diplomová práce se zabývá teoretickými a praktickými úskalími přestupků na pozemních komunikacích. Cílem práce je zanalyzovat problematické aspekty přestupků na pozemních komunikacích především z roviny aplikační, kriticky jej zhodnotit z pohledu de lege lata, ale i v souvislosti s připravovanou novelou zákona č. 361/2000 Sb., o provozu na pozemních komunikacích s ohledem na stále se zvyšující restrikce a poukázat na některé postupy při odhalování šetření přestupků. Práce je členěna na 6 částí. První část pojednává o historických souvislostech dopravního práva a počátcích restrikcí v dopravním právu. Druhá část vymezuje základní instituty provázející diplomovou práci. Ve třetí části jsou rozebrány prameny právní úpravy, jejich vzájemnost se současnými politickými trendy, jakožto i rozbor novely zákona o provozu na pozemních komunikacích. Čtvrtá část pojednává o specifických aspektech řízení o dopravních přestupcích. Pátá část je věnována vlastnímu výběru dopravních přestupků, jejich skutkovým podstatám, způsobu jejich odhalování a trestání. Na závěr autorka polemizuje s vlastními návrhy de lege ferenda. |
| Abstract in different language: | This Thesis's point of interest are difficulties with road traffic delicts. The goal of this thesis is to analyze problematic aspects of road traffic delicts mostly from application perspective, critically evaluate it from de lege lata point of view but also in context of future amendment to the law 361/2000 Coll about road traffic regulations with prospect of ever increasing restrictions, and to point of some of the processes in their investigations and enforcement. The work is divided into 6 sections. First section is about historical context of road traffic law and beginning of regulations in transportation law. Second section defines basic institutions which are going to be mentioned in the rest of the work. Third section disassembles sources of law regulation, their mutual connections with recent political trends and analysis of the new amendment of the law for road traffic regulation. Fourth section are about specific aspects of the operation of the delicts proceedings. Fifth section are about the delicts themselves, their definitions, investigation methods and punishments rulings. At the end the author evaluates her own suggestions de lege ferenda. |
