| Abstract: | Článek se zabývá vlivem římského práva na právní úpravu kanonického práva, tak, jak je upravena v CIC 1983. Zásada ecclesia semper vivit lege Romana je podle autora článku spíše proklamací, než vyjádřením aktuálního stavu. Zkoumá jak případy, kdy jsou jednotlivé instituce přebírány přímo z římského práva (úprava pohnutky při manželství: dolus, vis ac metus), zákaz manželství mezi únoscem a unesenou, atd. Věnuje se také případům, kdy úprava kanonického práva rozvíjí a podstatně přepracovává římsko-právní nauku a stává se tak (zásada pacta sunt servanda, zásada mala fides superveniens non nocet). |
| Abstract in different language: | The article deals with the influence of Roman law on the canon law, as it is regulated in CIC 1983. The principle of ecclesia semper vivit lege Romana, according to the author of the article, is a proclamation rather than an expression of the current state. It examines cases where individual institutions are taken directly from Roman law (the adjustment of motives in marriage: dolus, vis ac metus), the prohibition of marriage between the kidnapper and the kidnapped. It also deals with cases where the regulation of canon law develops and substantially revises the Roman law doctrine and does so (principle pacta sunt servanda, principle mala fides superveniens non nocet). |
