| Abstract: | Diplomová práce se zabývá problematikou transgender osob. Práce je zaměřena zejména na právní pojetí tohoto tématu, konkrétně hodnotí právní postavení těchto osob v České republice. První část se věnuje obecně trans osobám a objasnění základních pojmů. Další část je zaměřena na judikaturu Evropského soudu pro lidská práva. Následuje popis práv trans osob na úrovni vnitrostátní. Čtvrtá část se zaobírá procesem úřední změny pohlaví v České republice a následnou změnou osobních údajů. Ukazuje pohled na tento proces podle odborné literatury a následně odborníka z praxe. Dále jsou předloženy právní otázky vztahující se ke změně pohlaví, které navrhují možná řešení nedostatků. Poslední část této práce se zabývá budoucím právním vývojem v této oblasti. |
| Abstract in different language: | The thesis presents the topic of transgender people. The main focus is aimed to the legal frameworks in the Czech Republic. The first part outlines the basics of the transgender issue and terminilogy used in this field. The following chapter describes the practice of the European Court of Human Rights. The legal approach to the transgender people in the Czech Republic is described in the third chapter. The process of gender reassignment in the Czech Republic and the following administrative change of personal data are presented both from the theoretical and practical perspective. The problems of gender reassignment are discussed together with suggestions for improvement on them. The concluding chapter outlines the future development in this field. |
