| Abstrakt: | Tématem disertační práce je právní institut služebností. Stěžejním obsahem práce je obecné vymezení služebností podle současné právní úpravy. Práce je rozdělena do sedmi hlavních kapitol, kdy po úvodním vymezení se práce zabývá pojmem služebností, který je popsán i z historického pohledu, tedy jeho vývoje a je uveden i stručný exkurz do zahraničních úprav. V rámci této kapitoly je zkoumána i oblast vlastníkovy služebnosti, obsah, rozsah a předmět služebnosti a značná pozornost je věnována dělení služebnosti. Třetí kapitola je zaměřena na ochranu služebností. Navazující část práce pojednává o vzniku služebností, respektive jejich vzniku, zřízení a nabytí. Úhradu nákladů na zachování a opravu služebné věci, míru služebnosti, zákaz přenesení služebnosti a konkurenci služebností upravuje pátá kapitola nazvaná právní poměry ze služebností. V závěru práce je pak shrnut její přínos a je reagováno na v úvodu vymezené výzkumné otázky a hypotézy. |
| Abstrakt v dalším jazyce: | The topic of the dissertation is the legal institute of servitude. The thesis aims to provide a general definition of servitudes according to the current legislation. The thesis is divided into seven main chapters, where after the initial definition of the scope of the thesis, it deals with the concept of servitude, which is described from a historical perspective, i.e., its development, and is complemented with a brief look at legislation abroad. This chapter also examines the issues of owner's servitude and the content, scope and subject of servitude while considerable attention is paid to the division of servitudes. The third chapter focuses on the protection of servitudes as broadly as possible. The subsequent part of the thesis deals with the formation of servitudes - their origin, establishment and acquisition. Reimbursement of the cost of maintaining and repairing a servitude subject, the degree of servitude, prohibition on transfer of servitude and competition for servitude is elaborated in the fifth chapter titled Legal Relations of Servitudes. In conclusion, the thesis offers a summary of the contribution of servitude and answers to research questions and hypotheses laid out in the introduction. |
