| Abstract: | Tato práce pojednává o metodice vyšetřování organizovaného zločinu, jakožto nejvyšší formě organizované kriminality. Je rozdělena do šesti částí, které jsou vzájemně propojeny. První kapitola je zaměřena na historii organizovaného zločinu v mezinárodním kontextu a zmiňuje též počátky tohoto jevu na území ČR. Ve druhé kapitole jsou vymezeny základních pojmy, a to metodika vyšetřování jednotlivých druhů trestných činů a organizovaný zločin. Třetí kapitola pak pojednává o právních prostředcích a institucích participujících na boji s organizovaným zločinem, a to jak na úrovni národní, tak mezinárodní. Čtvrtá kapitola je jádrem práce, neboť zde jsou uvedeny jednotlivé zvláštnosti metodiky vyšetřování organizovaného zločinu. Převážná část této kapitoly je věnována zvláštnostem počátečních a následných úkonů ve vyšetřování, jako např. operativně pátracím prostředkům, výslechu svědka, spolupracujícímu obviněnému atd. Pátá kapitola se zaměřuje na trestněprávní hledisko organizovaného zločinu, konkrétně na pojem organizované zločinecké skupiny. V šesté kapitole jsou nastíněny tradiční formy organizovaného zločinu u nás a taktéž jeho aktuální stav. |
| Abstract in different language: | This dissertation deals with the methodology for investigation of organized crime as the highest form of crime committed by a group of offenders.The thesis is divided into six interrelated parts.The first chapter is devoted to the history of organized crime. Especially it is focused on the greatest powers of organized crime and also briefly discusses the beginnings of organized crime in the Czech Republic.The second chapter deals with the concept of methodology for investigation of each type of crime and also the concept of organized crime. The third chapter is related to the means of combating organized crime, especially to national and international key institutions and law instruments. The fourth chapter is the core of the thesis. There the peculiarities of methodology for investigation of organized crime are discussed. The largest part of the chapter deals with the particularities of the initial and subsequent acts of investigations. The subsections were devoted to some institutes of criminal procedural law. The fifth chapter studies the criminal aspect of organized crime. The sixth chapter deals with some forms of organized crime that are typical for the Czech Republic and also with the current state of organized crime there. |
