dc.description.abstract-translatedThis paper, presented at the “Hope of Legal Science 2022” conference, dealt with some aspects related to the cancellation and settlement of general co-ownership, in particular the question of examining the co-owner’s solvency in court proceedings, in which several co-owners want to order the same thing into their exclusive ownership for compensation to others. It was found that in these cases the question of co-owners’ solvency is essential, because the jurisprudence of the Supreme Court practically does not allow the thing to be ordered into the exclusive ownership of a co-owner who does not prove that he has sufficient financial resources to pay compensation to others (i.e. for the payment of others). In this regard, the jurisprudence al lows one exception, namely when the co-owner does not have the funds nec essary to pay the settlement share at the time of the decision, but at the same time clearly proves that he will obtain the necessary funds in a reasonable time. From this, it can be concluded that if the co-owner himself does not have sufficient financial resources to pay the settlement share to others and does not prove that he is able to obtain them soon, then the condition of solvency is not fulfilled and for this reason alone, the thing given to such a co-owner with a very with a high probability it will not be ordered.en
