| dc.description.abstract | Tato diplomová práce pojednává o tématu ochranného léčení, i s kapitolou o zabezpečovací detenci. Cílem práce je popsat stav tohoto institutu. Ochranné léčení je jedním z ochranných opatření. Jeho základním úkolem je ochrana společnosti před pachatelem trestného činu. Ochranné léčení může být uloženo ve formě ústavní či ambulantní. Může být ovšem uloženo i bez trestu, především pokud se jedná o nepříčetného pachatele. Dále je zde popsat institut zabezpečovací detence, a díle obě tyto ochranná opatření u mladistvého pachatele a dítěte mladšího 15 let. Diplomová práce obsahuje i komparaci s právní úpravou tohoto institutu v Německu a Rakousku | cs |

| dc.description.abstract-translated | In my theses I tried to identify and describe the institute of protective therapy, preventive detention. Both adult and juvenile offenders, even the children under the age of fifteen.I focused on the history specific institutions of legal regulation. Explanations of basic concepts that will help us to better understanding of power saving and protective therapy.What we can say about the protective therapy is that can be put into effect only by valid law in Czech Republic and can only be applied by court. Before this court decision has to be identified particular criminal act and the offender. This offender is examined for mental fitness which brings result whether he was at the time of offense sane or insane. This examination can be done by specialist of psychiatry, who prepares an expert?s opinion, which affects court?s decision.The court is asked a number of obligations, such as establishing the facts of the case, evaluate the evidence in the form of expert?s opinion. Court must be absolutely sure of their decision, especially when the constitutional protective therapy is imposed, because it is highly affects the personal rights of convicted offender. The protective therapy can be performed separately, or in addition to imprisonment. Protective therapy unfortunately does not guarantee to convicted offender, that he will be released on a specific time, since introduced two-year period in new criminal code No. 40/2009 since 1.1.2009, which must reconsider whether it is proposed for the extension or termination. | en |
