| Abstract: | Článek popisuje oprávnění advokáta vyhledávat, prověřovat, předkládat a navrhovat důkazy v trestním řízení. Na základě upozornění advokáta Mgr. M. K. na nevhodný postup soudů ve věci týkající se prověřování skutečností vztahujících se k obsahu výpovědi svědků již vyslechnutých v průběhu trestního řízení, jejichž výslech v dalších stádiích trestního řízení byl očekáván. Tímto upozorněním se zabýval Výbor pro odbornou pomoc a ochranu zájmů advokátů, o čemž pojednává tento článek. |
| Abstract in different language: | The article describes the lawyer's authority to search for, examine, submit and propose evidence in criminal proceedings. Based on the notice of the lawyer Mgr. M. K. on the inappropriate procedure of the courts in the case concerning the examination of facts related to the content of the testimony of witnesses already heard during the criminal proceedings, whose questioning was expected in the next stages of the criminal proceedings. This warning was addressed by the Committee on Professional Assistance and the Protection of the Interests of Lawyers, which is the subject of this article. |
