| Abstract: | Článek pojednává o domněnce otcovství vázané na udělení souhlasu k provedení umělého oplodnění. Navzdory přetrvávající praxi i judikatuře, která jí stále nepřiznává postavení plnohodnotné domněnky, tuto domněnku analyzuje a přibližuje, proč by tento přístup měl být přehodnocen. Analyzovány jsou zejména způsob vzniku otcovství a účel dané domněnky. Ačkoli má analyzovaná domněnka mnoho specifik, v základu se od jiných, "tradičních" příliš neliší. |
| Abstract in different language: | The article focuses on the presumption of paternity bound to giving consent to artificial insemination. Despite persisting judicial practice, which still does not consider it to be a full-bodied presumption, the article analyzes this presumption and explains why such attitude should be abandoned. Especially the origin of paternity and the purpose of the presumption are thoroughly analyzed. In the end, although the analyzed presumption is very specific, it does not, in general, differ that much from other, so-called "traditional" presumptions. |
