Abstract in different language: Taking evidence is a kind of cognitive process in which the court establishes the factual and legal basis of the dispute. In the civil process the object of knowledge is defined by the aim and purpose determined by the process itself. In the paper, we try to highlight the importance of taking evidence in the civil process, while taking into account the differentiation of the civil process and with a particular focus on fact-finding, as a reliable and complete basis for a correct and fair decision in a case
