| Abstract: | Tato práce se zabívá drogovou kriminalitou z pohledu trestního práva a kriminologie. Podrobně rozebírá českou protidrogovou trestněprávní legislativu obsaženou především v § 283 - 287 trestního zákoníku a nařízními vlády č. 467/2009 Sb. a 455/2009 Sb., které stanoví, jaké je množství větší než malé u přechovávaných drog, resp. které rostliny a houby s psychotropními a omamnými účinky podléhají a jaké je jejich množství větší než malé. Následující část se zabývá kriminologickými aspekty drogové kriminality, které jsou relevantní z hlediska trestního práva. Práce je zakončena zhodnocením právní platné právní úpravy a doplněa o návrhy de lege ferenda. |
| Abstract in different language: | This diploma work treats the drug criminality in the view of penal law and criminology. Purpose of this work is to decribe czech antidrug legal system mainly contained in the penal law in enactions § 283 ? 287, the goverment regulation no. 467/2009 Sb., which establishes what is the amount higher then low for the purpose of assessment criminal responsibility in case of holding drugs for delinquents own use and the goverment no. 455/2009 Sb., that establishes, which kind of plants and ?magic mushrooms? with narcotic effect are restricted and the amount higher than low of this plants and mushrooms. Next part describe criminological aspects of this kind of crime, which are important from the view of penal law. On the end of this work, there are proposals de lege ferenda. |
