| Abstract: | Tématem mé diplomové práce je ukládání a výkon ochranného léčení. Jedná se o ochranné opatření, které může být ukládáno pachatelům trestných činů i činů jinak trestných. Práce je členěna do šesti základních kapitol, které jsou dále rozděleny na jednotlivé části. Největší pozornost věnuji ochrannému léčení de lege lata, dále se zaměřuji na ochranné léčení vykonávané u mladistvých, ale nastiňuji také ochranné léčení v nizozemské právní úpravě. V Psychiatrické léčebně v Havlíčkově Brodě ověřuji podmínky výkonu ochranného léčení a zaměřuji se na to, zda je zde dodržován zákonný rámec. V závěru následně shrnuji svoje poznatky a polemizuji nad ochranným léčením de lege ferenda. |
| Abstract in different language: | The diploma thesis deals with the imposition and execution of protective therapy. It is a protective measure which can be imposed to offenders who committed criminal and other offences. The work consists of three basic chapters which are further divided to individual sections. The thesis is focused primarily on the de lege lata protective therapy, and also on the protective therapy of underage offenders and the protective therapy within the Dutch legislation. Conditions of the execution of protective therapy have been monitored in the Mental Hospital in Havlíčkův Brod with focus on the observance of legal framework. The conclusion of the thesis provides a summary of the findings and a discussion of the de lege ferenda protective therapy. |
