dc.description.abstractCílem této práce je seznámení se s problematikou institutu anonymního svědka, který je v České republice upraven ustanoveními trestního řádu. Dále chci ve své práci poukázat na rozpor mezi základními právy svědků a základními právy obviněných v trestním řízení v souvislosti s utajeným svědectvím, a to především za pomoci výkladu některých rozhodnutí Evropského soudu pro lidská práva a Ústavního soudu České republiky. V jedné z kapitol se budu zabývat institutem zvláštní ochrany svědka dle zákona č. 137/2001 Sb. o zvláštní ochraně svědka a dalších osob v souvislosti s trestním řízením a o změně zákona č. 99/1963 Sb., občanský soudní řád, ve znění pozdějších předpisů, který s institutem anonymního svědka úzce souvisí. Závěr mé práce bude věnován srovnání české právní úpravy s právní úpravou vybraných evropských zemí.cs

dc.description.abstract-translatedThe target of the thesis is to learn about the issue of the Institute of anonymous witnesses, which is regulated by enactments of the Czech criminal law. I would like to point out the conflict between the rights of witnesses and the rights of defendants in the criminal proceedings in connection with the anonymous testimony as dealt with in the resolutions of European Court of Human Rights and Constitutional Court of the CR. In one of the chapters the institute of speacial protection of witnesses and other persons in criminal proceedings, is dealt with. This issue is closely connected with the issue of the institute of anonymous witnesses. The final part of the thesis is dedicated to comparison of the Czech jurisdiction with the jurisdiction of some European countries.en
