| Abstract: | Článek se zabývá vztahem kanonického práva a kultury – analogicky v oné tripartici, kterou ve své Teorii práva nastínil Viktor Knapp: jednak kanonickým právem jako součástí kontinentální právní kultury (právního stylu), dále kulturností (kultivovaností) kanonického práva a konečně (a zejména) přínosem kanonického práva k právní kultuře obecně a k některým recentním právním odvětvím zvláště. Kanonické právo, vyrůstající od počátku v prostředí práva římského, stalo se v průběhu právních dějin jeho nejvýznamnějším recepčním faktorem. |
| Abstract in different language: | This paper examines the relation of canon law and culture in three meanings analogous to the division outlined by Viktor Knapp in his Theory of Law. Thus, the paper deals with canon law as part of the continental legal culture (legal style), then with the culture of canon law and finally and in particular with the contribution of canon law to the legal culture in general and also to some specific recent legal areas of law. The canon law in the beginnings grew in the environment of Roman law and in the course of legal history it became the most important reception factor of Roman law. |
