| Abstract: | Rigorózní práce se zaměřuje na problematiku krajní nouze a nutné obrany, tedy institutů vylučujících protiprávnost, které mají své stabilní místo v trestněprávní teorii i praxi, a samozřejmě i v trestních zákonech. V práci je detailně rozebrána platná právní úprava obou zmíněných institutů v českém trestním právu z pohledu samotného znění zákona, ale také z pohledu trestněprávní nauky a z pohledu soudní praxe a dále pak srovnání se slovenskou a německou právní úpravou. |
| Abstract in different language: | The rigorous thesis focuses on the issues of necessity and self defence, i.e. institutes that exclude unlawfulness, which have a stable place in criminal law theory and practice, and of course in criminal laws. The thesis deals with the valid legal regulation of both mentioned institutes in Czech criminal law from the point of view of the law itself, but also from the point of view of criminal law doctrine and from the point of view of judicial practice and then the comparison with Slovak and German law. |
