| dc.description.abstract | Svoboda je hlavním tématem čtenářům předkládané práce. V právních a demokratických státech je kladen důraz na svobodu jednotlivce. Svoboda člověka patří k základním hodnotám demokratického státu. Česká republika k těmto státům zajisté patří a svobodu jednotlivce podporuje a poskytuje jí ochranu. Cílem předkládané disertační práce proto je jednak vymezit prostor, ve kterém není nutné a žádoucí do smluvní svobody účastníků závazkových vztahů zasahovat či je některým z dovolených způsobů omezovat, a dále zkoumat přípustnost limitů a stanovení hranice smluvní svobody, které jsou autoritativně státní mocí vytvářeny a které již nelze překročit. Práce hodnotí dopady nové právní úprava občanského a pracovního práva v oblasti smluvní volnosti účastníků pracovněprávních vztahů vč. zkoumání platnosti a neplatnosti takovýchto jednání, chápání dispozitivnosti a provázanosti jednotlivých ustanovení obou kodexů, potažmo důsledků možného uvolnění pracovněprávní legislativy, vše s ohledem na rozhodovací praxi soudů, a to nejen českých ale i zahraničních. Práce dále též hodnotí, zda je změna zákoníku práce, prostřednictvím níž by došlo k uvolnění řady jeho striktních ustanovení, pro společnost žádoucí či nikoli. | cs |

| dc.description.abstract-translated | The freedom is the main topic of the thesis being presented to readers. In states respecting the rule of law and democratic states the emphasis is put on the individual liberty. The liberty of a human belongs to the fundamental values of a democratic state. The Czech Republic certainly belongs to such states and supports the individual liberty and provides protection to it. Therefore, an objective of the presented thesis is both to delimit an area in which it is neither necessary nor desirable to interfere with the freedom of contract of the parties to the relations resulting from an obligation or to restrict them in some of the permitted ways, and to further examine admissibility of the limits and setting the bounds of the freedom of contract that are authoritatively created by the state authority and that cannot be crossed. The thesis evaluates the impacts of the new legal regulation of the Civil and Labour Law in the field of the freedom of contract of the parties to the labour relations including the examination of validity and invalidity of such acts, understanding of directory nature and interconnection of single provisions of both codes, therefore the consequences of possible release of the Labour Law, all with respect to the decision-making practice of the courts, not only the Czech but also foreign courts. The thesis also evaluates whether or not the change of the Labour Code by means of which many strict provisions of the Labour Code would be released is desirable for the society. | en |
