| Abstract: | Tato práce se zabývá institutem nabytí od neoprávněného, který byl donedávna v našem právu velmi podceňován, ač jeho význam v praktickém životě stoupal. Práce si klade za cíl srovnat úpravu tohoto institutu v německém a francouzském právu a dále v historickém vývoji práva českého.Dále porovnává úpravu v novém občanském zákoníku, která znamená opětovný příklon k evropským tradicím. Na závěr se snaží z provedných srovnání zhodnotit pozitiva a negativa dílčích aspektů úpravy. |
| Abstract in different language: | This thesis deals with the Institute of unauthorized acquisition, which was until recently very underestimated in our law system although its relevance in everyday life increased. The work aims to compare our legislation institute with the German and French law and in the historical context of Czech historical development. It also compares the legislation in the new Civil Code, which again inclinates to European traditions. Finally, this work tries to assess the pros and cons of partial aspects of the legislation. |
