| Abstract: | Tato práce se zaměřuje na analýzu právních aspektů ochrany obchodní firmy. V úvodní části jsou vysvětleny pojmy stěžejní pro tuto práci, dále je nastíněn též historický vývoj pojmu "obchodní firma" a jeho pojetí v novém občanském zákoníku. Následuje popis samotné ochrany firmy na základě jednotlivých předpisů soukromého a částečně též veřejného práva, přičemž největší důraz je kladen na právní prostředky, které zakotvuje obchodní zákoník. Naleznete zde rovněž analýzu ochrany "obchodní firmy" dle práva Velké Británie ve srovnání s úpravou českou. |
| Abstract in different language: | This thesis focuses on analysis of legal aspects of business name protection. Terms essential for this thesis are explained in the introductory part, the historical development of the term "business name" is outlined further as well as its concept in the new Civil Code. This is followed by a description of the business name protection itself according to individual civil and partly also public law statutes, whereas the main focus is on legal instruments set down in the Commercial Code. You can also find an analysis of "company/business name" protection according to law of Great Britain in comparison with the Czech regulation. |
