| Abstract: | Diplomová práce na téma správa justice se zaměřuje především na správu soudnictví podle platné právní úpravy. V první části práce se věnuji státní správě soudů dle zákona o soudech a soudcích. Dále zmiňuji náznak tzv. soudcovské samosprávy v podobě soudcovských rad. V druhé části práce uvádím devět vybraných evropských zemí, jejichž modely správy soudnictví jsou charakteristické pro teoretické koncepty, které vytyčil Ústavní soud. V závěrečné části práce kriticky zhodnocuji úpravu správy soudnictví v České republice a snažím se navrhnout možný budoucí model úpravy správy soudnictví. |
| Abstract in different language: | The topic of dissertation focuses on a administration of justice, especially the administration of judicature according the valid legal adjustment. The first part of the dissertation deals with state administration of courts according the law of courts and judges. Furthermore, the paper describes judicial authority of the Judicial Councils. Second part of the dissertation focuses on the nine European countries, whose models of administration of justice are characterized by theoretical concepts which were established by the Constitutional Court of the Czech Republic. The last chapter is primarily a criticism of adjustment of administration of justice in the Czech Republic. This part intends to suggest a potential model of the future possible modification of the State Regulation of Courts in the Czech Republic. |
