| Abstract: | Tato diplomová práce pojednává o právní úpravě zvláštní územní ochrany přírody a krajiny. Je rozdělena do deseti kapitol, přičemž prvně je věnována pozornost obecnému vymezení práva ochrany přírody a krajiny a následnému definování zvláštní územní ochrany. Dále jsou popsány prameny právní úpravy zvláštní územní ochrany, které jsou rozděleny na prameny mezinárodní, evropské a vnitrostátní. Další část diplomové práce je zaměřena již výhradně na zvláště chráněná území, a to na jejich rozdělení, nástroje ochrany, ochranné podmínky, státní správu a deliktní odpovědnost. Závěrem jsou představena velkoplošná zvláště chráněná území, která jsou připravována k vyhlášení. Cílem této diplomové práce je tedy popsat a analyzovat platnou právní úpravu zvláštní územní ochrany přírody a krajiny v České republice s následným zhodnocením i její dostatečnosti a se zohledněním již nastalých i budoucích legislativních změn. |
| Abstract in different language: | This thesis deals with the legal regulation of special territorial protection of nature and landscape. It is divided into ten chapters, the first of which focuses on the general definition of nature and landscape protection law and the subsequent definition of special territorial protection. Next, the sources of the legal regulation of special territorial protection are described, which are divided into international, European and national sources. The next part of the thesis focuses exclusively on specially protected areas, namely their division, protection instruments, protection conditions, state administration and tort liability. Finally, the large-scale specially protected areas that are being prepared for designation are presented. The aim of this thesis is therefore to describe and analyse the current legislation on special areas of nature and landscape protection in Czech republic, with a subsequent assessment of its sufficiency and taking into account the legislative changes that have already occurred and those that will occur in the future. |
