| Abstract: | Diplomová práce se zabývá zásadou individualizace trestání, která se uplatňuje při rozhodování o druhu a výměře trestu, a má na ně zásadní vliv. Jednotlivé části práce jsou zaměřeny na všechny složky zásady individualizace. První část diplomové práce pojednává o zákonné individualizaci a jednotlivých okolnostech důležitých pro rozhodování o druhu a výměre trestu, vyplývajících z § 39 trestního zákona. Její druhá část se věnuje soudcovské individualizaci a institutům s ní související. Třetí kapitola pojednává o penitenciární individualizaci, která souvisí s řádným výkonem trestu. Poslední část tohoto pojednání se zaměřuje na rozbor soudních rozhodnutí a komparaci české právní úpravy s vybranými zahraničními úpravami. |
| Abstract in different language: | This thesis deals with the principle of individualization of punishment, which is applied when deciding on the type and the level of punishment, and has a fundamental influence on them. Individual parts of this thesis are focused on all components of the principle of individualization. The first part of the thesis deals with legal individualization and individual circumstances important for deciding on the type and the level of punishment, resulting from § 39 of the Criminal Code. It's second part is devoted to judicial individualization and related institutes. The third chapter deals with penitentiary individualization, which is related to the proper execution of the sentence. The last part of this treatise focuses on the analysis of court decisions and the comparison of Czech legislation with selected foreign regulations. |
