Abstract: | Tato diplomová práce se věnuje jednomu z mimořádných opravných prostředků, a to stížnosti pro porušení zákona. Hlavním cílem diplomové práce je čtenáři přiblížit tento institut. Práce je členěna do 4 hlavních kapitol a mimo to obsahuje také úvod, závěr a cizojazyčné resumé. První kapitola se věnuje historii stížnosti pro porušení zákona. Na tento historický úvod navazuje kapitola vysvětlující právní úpravu de lege lata a pojednává o mimořádných opravných prostředcích a jejich rozdílech. Kapitola třetí se zaměřuje na komplexní představení stížnosti pro porušení zákona, tedy popisuje předmět, přípustnost, účel, podněty, podání a rozhodnutí o stížnosti pro porušení zákona. Zároveň jsou zde uvedena vybraná rozhodnutí Nejvyššího soudu. Poslední kapitola pojednává o budoucnosti stížnosti pro porušení zákona v rámci nově připravovaného trestního řádu. |
Abstract in different language: | This thesis focuses on one of the extraordinary remedial measures namely the Complaint for a Breach of Law. The main aim of the thesis is to introduce the reader to the desired issue. The work is divided into 4 main chapters and contains an introduction, conclusion and foreign language summary, as well. The first chapter deals with the history of the complaint for breach of law. This historical introduction is followed by a chapter explaining the de lege lata legislation and discussing extraordinary remedies and their differences. The third chapter refes to a comprehensive introduction to the complaint for breach of law, i.e. it describes the subject matter, admissibility, purpose, motives, filing and decision on the complaint itself. At the same time, selected decisions of the Supreme Court are presented. The last chapter deals with the future of the complaint for breach of law in the framework of the newly prepared Criminal Procedure Code. |
