| Abstract: | Diplomová práce se zabývá problematikou přiznávání práva na účinné vyšetřování trestných činů osobě poškozeného. Cílem práce je především získat odpověď na otázku, zda takovýmto právem v rámci českého právního řádu disponuje každý poškozený, a v případě záporné odpovědi, jaké musí být z jeho strany splněny požadavky. Pro nalezení odpovědi na položenou otázku provádí práce rozbor stěžejní judikatury Ústavního soudu a Evropského soudu pro lidská práva. |
| Abstract in different language: | The thesis deals with the issue of granting the victim the right to an effective criminal investigation. The aim of the thesis is to obtain an answer to the question whether such a right is available to every victim within the Czech legal system and, in case of a negative answer, what requirements must be met on his part. In order to find an answer to the question asked, the thesis analyses the core case law of the Constitutional Court and the European Court of Human Rights. |
