| Abstract: | Diplomová práce se zabývala principem proporcionality ve správním řízení. Začátek této práce popisoval proces správního řízení a základní zásady správního řízení. V práci jsem se zaměřil na vysvětlení principu proporcionality a jeho členění na zásady zákazu zneužití správního uvážení, zásadu ochrany dobré víry a oprávněných zájmů a zásadu subsidiarity. Závěr této práce jsem věnoval judikatuře zabývající se principem proporcionality a zmíněnými zásadami. |
| Abstract in different language: | The thesis dealt with the principle of proportionality in administrative proceedings. The beginning of this thesis described the process of administrative procedure and the basic principles of administrative procedure. In the thesis I focused on explaining the principle of proportionality and its division into the principles of prohibition of abuse of administrative discretion, the principle of protection of good faith and legitimate interests and the principle of subsidiarity. The end of this thesis dedicates on the jurisprudence of the principle of proportionality and the aforementioned principles. |
