| Abstract: | Práce se zabývá zajištěním dluhu formou zástavního práva a zajišťovacího převodu práva. Všímá má si podobnosti těchto institutů a upozorňuje na jejich rozdíly. Rozebírá možnosti vzniku zástavního práva nejen na smluvním základě a stranou nenechává ani vznik zajišťovacího převodu práva. Zároveň řeší i problematiku uspokojení věřitele při nesplnění zajištěného dluhu. A to jak různými způsoby výkonu zástavního práva, tak i realizaci zajišťovacího práva. Konečně je v rámci práce upozorněno i na některá úskalí, či neřešené právní otázky, přičemž je nabízeno jejich možné řešení. |
| Abstract in different language: | The present study delves into the intricate domain of debt securities, focusing specifically on lien and security transfer of rights. The author recognizes the similarities between these two entities while emphasizing their distinctive characteristics. Extensive examination is conducted to explore the potential for establishing a lien not only on the grounds of a contractual agreement, but also through the mechanisms of security transfer of rights. Moreover, the study addresses the complex issue of satisfying creditors in situations where the secured debt remains unfulfilled. This endeavor encompasses exploring various approaches to exercising the right of lien, as well as the practical implementation of the security right. Additionally, the study highlights several legal quandaries and unresolved matters, offering potential solutions to these challenges. |
