| Abstrakt: | Diplomová práce se zabývá ukládáním povinností formou obecně závazných vyhlášek územně samosprávných celků, což je forma podzákonné právotvorby, ke které jsou obce Ústavou České republiky zmocněny. V první části se práce zabývá ukládáním povinností v právním státě, jak je vymezuje Ústava ČR, některé vybrané evropské ústavy a jak se k němu stavěly vybrané Československé ústavy. Práce se dále věnuje právotvorbě územních samosprávných celků, vymezuje samostatnou a přenesenou působnost. Hlavní část je zaměřená převážně na zmocnění k vydávání obecně závazných vyhlášek, jejichž obsahem jsou právní povinnosti pro fyzické a právnické osoby. Věnuje se vztahu zmocnění v čl. 104 odst 3 Ústavy a čl. 4 odst. 1 Listiny, kdy práce v hlavní části vymezuje limity pro ukládání povinnosti v obecně závazných vyhláškách, jak jsou k tomu obce Ústavou, zákonem o obcích a dalšími zvláštními zákony zmocněna a tak, jak na zmocnění nahlíží ve své judikatuře Ústavní soud, který je jako jediný oprváněn pro nesoulad se zákony obecně závaznou vyhlášku samosprávných celků zrušit. Ke konci práce je úvaha de lege ferenda nad oblastmi, které by obce dle názoru autora měly regulovat, ačkoliv tak dnes činit nemohou. |
| Abstrakt v dalším jazyce: | The thesis deals with the issue of imposed obligations in form of the generally binding regulations which are imposed by local governmental units. The generally binding regulation is a sort of delegated legislation to which the municipalities are empowered by the Constitution of the Czech Republic. The aim of this thesis is to determine the limits of such an imposition of these obligations. The first part of this thesis presents a thorough analysis of imposing obligations in a legal state as defined by the Constitution of the Czech Republic in comparison to particularly selected european constitutions, and also to a historical reflection of the selected constitutions of Czechoslovakia. The thesis further deals with a process of law making of the local governmental units and defines the differences between self-governing and delegated authority. The main part of this thesis is focused on the authorization to issue generally binding regulations which include legal obligations for natural and legal persons. In the thesis is also analysed the relation of authorization given by article 104, paragraph 3 of the Constitution and article 4, paragraph 1 of the Charter of Fundamental Rights and Freedoms of the Czech Republic, where this thesis defines the limits for an imposition of the obligations included in the generally binding regulations which are issued by local governmental units. This authorization is given by the Constitution, the municipalities act and other particular acts. Moreover, the authorization is supervised by the judicial reviews of the Constitutional Court of the Czech Republic which is the sole organ entitled to derogate the generally binding regulation in case of not being in compliance with the primary legislation. The last part of this thesis includes author's consideration de lege ferenda, concerning the areas which should be regulated by the municipalities, althought nowadays, they cannot do so. |
