| Abstract: | Obsahem diplomové práce je komparace nového kontrolního řádu z roku 2012 a předešlého zákona o státní kontrole. Zaměřuje se převážně na odlišnosti a důvody nutnosti přijetí nového zákona, historický kontext a systematický postup od samotných základů kontrolní činnosti v České republice. Podrobně se věnuje zejména rozšíření působnosti kontrolního řádu, což je shledáváno jako ta nejinvazivnější změna, kterou nová právní úprava přinesla, neopomene se však důkladně věnovat ani průběhu kontroly, právům a povinnostem kontrolních subjektů a dalším institutům. Cílem diplomové práce je také odhalit při komparaci všechna zákoutí zdánlivě podobných ustanovení a najít i drobné změny, které se mohou na první pohled zdát takřka neviditelné. A takových změn se v obou zákonech nachází mnoho. |
| Abstract in different language: | The diploma thesis is focused on the comparison of The Act On Public Control of 1991 and the new Inspection Code which became effective on January 1, 2014. First of all it is necessary to name and divide the types of supervision activities, then to show The Act On Public Control of 1991 and the new Inspection Code from the perspective of launching and acceptance and then it is possible to start to compare. The most important for the comparison are the general aspects of control of both law regulations, especially its definition and the sphere of power, which is one of the most invasive changes. It is necessary also to compare the control in terms of its launching and application process. In some cases, while comparing the acts, the provisions seems to be the same which could be misleading because the impact on law is not as I aimed to explain. |
