Abstract: Práce pojednává o dnes již zaniklých institutech středověkého trestního práva procesního, ale částečně se pokouší postihnout i jeho hmotněprávní úpravu. Jádrem práce je pojetí svodu, nároku a hlavy v českém právním prostředí, a doplněny jsou komparacemi s ostatními právními kulturami, jako jsou slovanské (ruské a jihoslovanské), anglosaské a frankoněmecké právní prostředí. Zdánlivě rozdílné právní kultury (zejména prostředí slovanské a anglosaské) však podávají obraz poměrně jednotného vnímání výše zmíněných institutů procesního práva trestního. Středověké společnosti měly tedy stejné hodnoty a stejnou potřebu tyto hodnoty chránit. Z našeho pohledu tyto hodnoty byly až drakonicky chráněny, ale je to jen první dojem, poněvadž pokud se do problematiky ponoříme hlouběji, shledáváme, že i z trestu smrti bylo možné se vykoupit, byť to byla eventualita pouze pro majetnější vrstvy společnosti. Dalším společným jevem byla i téměř shodná doba zániku či přeměny těchto institutů. Vesměs se neobjevují v době vrcholícího středověku, kdy se již plně rozvinuly složité společenské vztahy. Právě v této době již výše zmíněné instituty přechází z ryze soukromoprávní oblasti do oblasti veřejnoprávní. V okamžiku, kdy svod není již záležitostí soukromého zájmu, ale přistupují stále častěji do tohoto procesu veřejnoprávní instituce, svod ve své původní podstatě zaniká. Podobně je tomu i v případě hlavy, příhlavních peněz, wergeldu. U nároku je situace poněkud složitější, jelikož zde bylo několik významů tohoto institutu. Jeden z nich nárok ve smyslu žaloby z nactiutrhání, přežívá déle, než ostatní významy tohoto institutu. Nárok jako způsob infamace však v pozdějším pojetí již není spojován se ztrátou práv, jako tomu bylo původně. Práce neobsahuje zcela vyčerpávající údaje, jelikož to v množství pramenů, které pro sledovanou oblast existují, ani není možné. Ale pokouší se čerpat alespoň z těch, které výše uvedené instituty nejen obsahovaly, ale bylo z nich možné také vyčíst informace, které by pomohly více pochopit jejich původní obsah. Snad se alespoň částečně podařilo vytýčený úkol splnit a zároveň tak otevřít tuto problematiku dalšímu zpracování a doplnění.
Abstract in different language: Customary law is the area of legal history falling into prehistory period and surviving until the first legal codifications (for example Code of Dušan, Vinodol Code in Yugoslav environment, statutes of Konrad Otto in Czech environment, Code of Athelbert of Kent, etc. in the Anglo-Saxon world) and in many places until the present days. Earlier were studies of common law the domain of legal history, today in our country and abroad ethnologists rather than lawyers are engaged with this issue. In the field of research of customary law are intertwined two main disciplines - Law and Ethnology. Have legal historian and ethnologist a different view on the common law? What methods are used in those scientific professions? At the beginning of the last century had Slovak ethnology a sophisticated methodology of the common law research. It was a questionnaire method. So far legal history has known no other method than the comparison, which was pioneered by historians and archaeologist. The aim of this work is to provide an overview of the occurrence and development of two legal institutions, which don´t appear in the legal system any more to give evidence and defamation of character. To give evidence, it´s a special process of inquiry in cases of disputed ownership and charges of theft, especially of livestock. The accused party was called upon to give an account of his possession of the animal, and from whom he had originally acquired it; that person was then sent for and interrogated, and so on, until the whole history of the animal was traced back, and the existence, or otherwise, of a theft finally proved. If we compare the incidence of both stated institutes in the Czech legal environment, it can be concluded that both of them have been most common until the end of the 13th century, when they disappeared from legal sources or when they transformed into other forms of procedural law. In the case of giving evidence was apparent that it ceased perhaps before defamation of character. Apparently on the grounds that it was a management process which consisted only in the private process of searching for a thief of stolen goods, while defamation character was an institute, which appeared in the modified form even in the 15th century. In the case of defamation character, which we consider in its original form, as an accusation of a person accused of stealing, was also originally a private system, but in later times, when the process management in public service was transformed, defamation character was changed in today´s concept of prosecution. Originally were both institutes very complicated process, and maybe, as the many sources of law state, this was the reason of their termination and in their place was put a process, which hasn´t already taken place out of court. A sort of exception to this statement is documented process called snoop, which is the search of evidence in the area of Transcarpathian Ukraine at the beginning of the last century. The comparative method that was used here shows that both institutes of procedural law have appeared in Slavic, Anglo-Saxon and Franco-German environment. The longest surviving was again the institute of defamation of character as in calumny as in the process of accusation of stealing in the so-called Sachsenspiegel, which has been also used in our country in relation to the urban law. In this case we can as well observe that at the moment when the accusation of stealing are moving from a private level to public one, the whole process simplifies and takes place only in a court.
