| Abstract: | Hlavním cílem této práce je vysvětlit argumentační metodu - test proporcionality, a poté ukázat jeho použití v judikatuře Ústavního soudu na vybraných případech a na a různých typech řízení. Aplikace testu proporcionality je zkoumána z pohledu českého a francouzského ústavního systému. V prvních kapitolách práce pojednává o ústavním soudnictví z pohledu České republiky a Francie, věnuje se jejich kompetencím a judikatuře obecně. Dále se práce zabývá základními lidskými právy a svobodami a jejich omezeními, ke kterým dochází při aplikaci testu proporcionality. V závěru porovnává výsledky a rozdíly mezi uplatňováním testu proporcionality v České republice a aplikací testu proporcionality ve Francii, v souladu s rozebranými případy. Hlavní otázkou nadále zůstává, zda se test proporcionality může stát univerzálním testem ústavnosti a jestli dokáže nabídnout soudům uplatňování rozdílné intenzity přezkumu základních práv a svobod a současně představovat relativně předvídatelný model takového přezkumu. |
| Abstract in different language: | The main objective of this work is to explain the argumentative method - the test of proportionality, and then show its application in the case law of the Constitutional court in selected cases, and in different types of proceedings. The application of the test of proportionality is examined from the point of view of the Czech and the French constitutional system. In first chapters the work discusses the constitutional judiciary from the point of view of the Czech Republic and France. These chapters are dedicated to their competencies, and case law in general. Furthermore, the work deals with the fundamental human rights and freedoms and their limitations, which occur in the application of the proportionality test. The conclusion compares results and differences between the application of the proportionality test in the Czech republic and the application of the test of proportionality in France, in accordance to the described cases. The main question remains, whether the test of proportionality can become a universal criterion of constitutionality and whether judges may offer the application of different intensity reviewing the basic rights and freedoms, and if the judges can also guarantee quite a predictable model of such a supervision. |
