| Abstract: | Práce se zabývá historickým vývojem spolkového práva a vývojem spolků v Československu v letech 1918-1990. Právo sdružovat se ve spolcích představuje v demokratických státech základní ústavní právo. Spolky prošly řadou proměn, které se promítly do každodenního fungování spolků, resp. do práva shromažďovacího. Zásadní okamžik pro vývoj spolkového práva byl rok 1848, ve kterém bylo svobodné spolčování základním požadavkem tehdejšího měšťanstva. S ohledem na politický vývoj docházelo k různým přístupům k rozvoji práva shromažďovacího, což vedlo buď rozvoji spolků, nebo potlačení jejich činnosti. Práce analyzuje různé typy spolků a představuje jejich roli. Zachycuje veškeré milníky vývoje spolků v letech 1918 až 1990, které měly vliv i na dnešní podobu spolkového práva a činnosti spolků v České republice. |
| Abstract in different language: | The work deals with the historical development of association law and the development of associations in Czechoslovakia in the years 1918-1990. In democratic states the right to associate representing basic constitutional right. Associations have undergone a number of changes that are reflected in daily functioning of the associations or to the rights of the assembly. The essential moment for the development of the association law was year 1848 that the freedom of association was a fundamental requirement of the then bourgeoisie. With regard to the political developments there were different approaches to the development of the law of assembly that led to the development of societies or to the suppression of their activities. The work analyzes the different types of associations and represents their role. Captures all the milestones of the development of associations in the years 1918 to 1990 that had an impact even on nowadays form of association law and an act nd activities of the associations in the Czech republic. |
