| Abstract: | Práce pojednává o institutu nepřikázaného jednatelství. Cílem práce je poskytnout obecný přehled a rozbor platné právní úpravy nepřikázaného jednatelství, ale též přiblížit vztah nepřikázaného jednatelství a vybraných právních institutům, konkrétně problematiku jejich vzájemného odlišení. Práce je rozdělena na dvě části. První část se věnuje obecnému seznámení s nepřikázaným jednatelstvím. Jeho zařazení do systematiky zákona, stručnému historickému vývoji, pojmovým znaků nebo právům a povinnostem subjektů. Blíže pojednává o jednotlivých druzích nepřikázaného jednatelství, především o užitečném a nutné jednatelství. Druhá část práce se věnuje nepřikázanému jednatelství ve vztahu k vybraným právním institutům, například k prevenci škod, bezdůvodnému obohacení či krajní nouzi. |
| Abstract in different language: | The thesis deals with the institute of negotiorum gestio. The aim of the thesis is to provide a general overview and analysis of the current legal regulation of the negotiorum gestio, but also to bring closer the relationship of uncontrolled negotiation and selected legal institutes, namely the issue of their mutual differentiation. The thesis is divided into two parts. The first part deals with general identification with negotiorum gestio. It deals with inclusion in the systematics of the law, brief historical development, conceptual features or the rights and obligations of subject. Closer deals with individual types of negotiorum gestion, especially with the useful and necessary negotiorum gestio. The second part of the thesis deals with uncontrolled negotiation in relation to selected law institutes, for example prevention of damage, unjust enrichment, or extreme necessity. |
