| Abstract: | Předmětem diplomové práce je zkoumání problematiky práva veřejného a práva soukromého - právního dualismu. Prvně je pozornost věnována základnímu pojmovému vymezení.Následně jsou rozebírány významné teorie rozdělování práva na veřejné a soukromé. Práce obsahuje také historický exkurz zabývající se dualismem. Závěrem se práce zabývá některými významnými interpretačními pravidly jak v soukromém tak veřejném právu a pohledem judikatury soudů dotýkající se právního dualismu. |
| Abstract in different language: | The objective of the thesis is research on the problematics of public rights and private rights - dualism of rights. Firstly attention is given to defining these concepts. Then significant theories about the separation of rights, into public rights and private rights, are discussed. The work also contains a historical excursion. The conclusion concerns itself with some significant interpretational rules pertaining to private and public rights, and through the view of court rulings affecting dualism of rights. |
