| Abstract: | Diplomová práce je věnována problematice významu pojmu jednotka a jejímu vymezení v rámci nemovité věci. Autor vysvětluje pojem "jednotka" a přibližuje jeho význam v kontextu současné i minulé právní úpravy. Stěžejním bodem je objasnění všech úskalí, na které lze v souvislosti s vymezením jednotky narazit. Stranou pak nezůstává ani povaha jednotky po rekodifikaci soukromého práva a dopad superficiální zásady do sféry bytového spoluvlastnictví. Autor se tedy věnuje i komplikovaným otázkám jako je vymezení jednotky v rámci práva stavby nebo podzemní stavby se samostatným účelovým určením a uplatnění či neuplatnění zákonných předkupních práv. Významná část práce je také věnována termínu společné částí nemovité věci, přičemž bez jeho pochopení není možné jednotku správně vymezit. |
| Abstract in different language: | The thesis is devoted to the issue of the meaning of the term unit and its definition in the real estate. The author explains the term "unit" and explains its meaning in the context of current and past legislation. The key point is to clarify all the pitfalls that can be encountered in defining the unit. Also the nature of the unit after the recodification of private law and the impact of the superficial principle on the housing co-ownership area are not left out. Thus, the author also deals with complicated issues such as the definition of a unit under the right of construction or an underground structure with a separate purpose and application or not application legal pre-emption rights. A significant part of the thesis is also devoted to the term common part of the real estate, while without its understanding it is not possible to define the unit correctly. |
