| Abstract: | Práce se věnuje problematice součásti a příslušenství věci. Historicko-komparativní metodou srovnává význam těchto pojmů v právu římském a moderním, zejména pak v občanských zákonících z roku 1964 a 2012. Také podává výklad věci v právním smyslu, který je nezbytný pro pochopení institutu součásti a příslušenství věci. Zvláštní důraz je kladen na problematiku součásti pozemku a s ní související zásadu superficies solo cedit. Závěrem se práce také zabývá právním postavením plodů a užitků věci a nabývání vlastnictví k nim z pohledu práva římského a současného. |
| Abstract in different language: | The thesis deals with the issue of parts and accessories of things. It uses historical-comparative method to compare the meaning of these terms in Roman and modern law, especially in the Civil Codes of 1964 and 2012. The thesis also provides the interpretation of thing in the legal sense, which is necessary for understanding the institute of parts and accessories of things. Particular emphasis is placed on parts of land and the associated principle of superficies solo cedit. The final part of the thesis addresses the legal status of natural fruits and civil fruits of things and their acquisition from the perspective of Roman and modern law. |
