| Abstract: | Diplomová práce si klade za cíl odpovědět na otázku, zda je advokátní odměna přiměřená, tak jak to vyžaduje zákon o advokacii a advokátní kodex. Aby bylo téma lépe pochopitelné, bylo nutné nastínit stručný historický vývoj odměňování advokátů. Popisuji dolní a horní hranice advokátní odměny. Advokátní odměnu rozděluji na smluvní a tarifní. Dále popisuji, jaké jsou procesní požadavky na advokáta, aby mu byla přiznána náhrada nákladů řízení. Část diplomové práce je věnována i odměňování advokátů v zahraničí. |
| Abstract in different language: | The aim of the thesis is to answer the question whether the lawyer's remuneration is reasonable, as required by the Law of Advocacy and the Law Code. For a better understanding of the subject, it was necessary to outline a brief historical development of lawyers' remuneration. I describe the lower and upper limits of lawyers' fees. I divide my attorney's fees into contractual and tariff. I further describe the procedural requirements for a lawyer to be ordered to pay the costs. Part of the thesis is devoted to the remuneration of lawyers abroad. |
