| Abstract: | Tato diplomová práce si klade za cíl podrobit rozboru institut bezdůvodného obohacení. Nejprve jej uvede historickým exkurzem, na který navazuje podrobnější výklad týkající se jeho regulace v občanském zákoníku České republiky. Konkrétně zprvu pojednává o smyslu a účelu generální klauzule a jednotlivých skutkových podstatách bezdůvodného obohacení. Následně je věnována pozornost jeho negativnímu vymezení, problematice restituce v případě jeho vypořádávání a regulaci jeho promlčení. Závěrem se práce stručně dotýká bezdůvodného obohacení v kontextu práva unijního. |
| Abstract in different language: | The main goal of this thesis is to analyse the legal basis of unjust enrichment. It begins with a historical introduction, which continues with a detailed examination of its´ regulation concerning the unjust enrichment in the civil code of the Czech Republic. Specifically, it first focuses on the function of the general clause and individual factual cases of unjust enrichment. Next a closer look is taken on negative limitations, the problematic concerning restitution during its' reversal and the regulation of time limitation that is given by the legal order so as to achieve reclamation of unjust enrichment. Finally, this thesis also points out unjust enrichment in the context of European union law. |
