| Abstract: | Téma mé práce se týká úplatkářství z hlediska trestně právního a trestně procesního. Úplatkářství úzce souvisí s korupcí. V první kapitole jsou tyto dva pojmy definovány a je zde vymezen jejich vztah. Dále je pojednáno o jednotlivých trestných činech na základě platné právní úpravy trestního zákoníku jako je přijetí úplatku, podplácení a nepřímé úplatkářství. Další kapitola upravuje procesní instrumenty napomáhající k odhalování a objasňování této kriminality. Dále jsou zde uvedeny některé významné mezinárodní protikorupční nástroje a v neposlední řadě i boj proti korupci v rámci České republiky. |
| Abstract in different language: | The theme of my work relates to the bribery in terms of the criminal law and the criminal procedure. The bribery is closely linked with the corruption. In the first chapter, these two concepts are defined and defined their relationship. Furthermore, we discuss the various offenses under existing legislation such as the Criminal Code, receiving a bribe, bribery and indirect bribery. The next chapter provides the procedural instruments conducive to the detection and investigation of the crime. There are also some of the major international anti-corruption tools against the corruption and also the fight against the corruption in The Czech Republic. |
