| Abstract: | Ve své rigorózní práci se zaměřuji zejména na problematiku zastavení podílu společníka ve společnosti s ručením omezeným. Práce zkoumá odbornou literaturu, právnická periodika a pokouší se vystihnout také aplikovatelnost dosavadní judikatury na novou právní úpravu. Hlavním přínosem práce je poskytnutí výkladu k ustanovením, o kterých doposud nepanuje v právnické obci shoda, a také upozornění na výkladové a praktické problémy a případná rizika, které právní úprava přináší. Závěr rigorózní práce je věnován shrnutí závěrů, ke kterým jsem v práci dospěla. |
| Abstract in different language: | In my rigorous thesis I focus mainly on the issue of pledging a share in a limited liability company. The thesis examines the legal professional literature, legal periodicals and also tries to capture the applicability of existing legislation. The main benefit of this thesis is the provision of an interpretation of the legal regulations on which there is no reached agreement in the legal community so far, as well as a warning of interpretation and practical problems and possible risks that the current may legislation bring. The conclusion of the rigorous thesis is devoted to a summary of the conclusions I reached. |
